Understanding ‘Age Requirement’ Legislations on Porn Websites

The government therefore proposed a new regulation in Spring 2018 to introduce age verification mechanisms and restrict children’s access to pornography.

Using age-verification systems will prevent children accessing adult and harmful content on these sites. The law covers videos or parts of videos that are already assigned an R18 certificate as well as “any other material” that would be rated-18. It will also cover any work that is “produced solely or principally for the purposes of sexual arousal.”

Following the new legislation, Internet users will have to prove they are over the age of 18 before accessing porn. Adult sites will be required to invest in age-verification softwares, such as AgeID; used by adult industry giants PornHub; Brazzers and YouPorn. Companies that refuse to comply with the new age-verification regulation, can be fined up to £250,000 or five per cent of their “qualifying turnover”. Regulators can also ask third-party services to withdraw their support.

There are many ways that age verification could work under the new plans. But the government is leaving this up to the industry to decide. For example, a system that uses credit card authorisation; like gambling websites, could be introduced. Otherwise, users will be required to login into the system with an email address and password, which will use a third party system to check their age – like AgeID does.

In terms of privacy for your users, The British Board of Film Classification (BBFC) will be working with the Information Commissioner’s Office (ICO), to ensure all age-verification providers comply with its data protection rules.
